Expropriation for the Construction of Motorways and Expressways in the Republic of Serbia

The Sector for Legal, Staff and Common Affairs of “Roads of Serbia“, during the period from September 2008 to the present day, has completed expropriation procedures that enabled the construction of motorways and expressways with a total length of 730 km.

A total of 7,000 hectares of land, corresponding to 51,000 cadastral parcels, have been expropriated.

The compensation paid for the expropriated real estate amounted to RSD 46,557,634,473.00, or EUR 396,235,187.00.

The expropriation procedure is conducted exclusively before the competent property and legal affairs departments of the municipalities and cities through whose territory the future motorway passes. As the beneficiary of expropriation, “Roads of Serbia” initiates the expropriation procedure by submitting an expropriation proposal.

The municipal administrative authority notifies the parties concerned of the initiation of the expropriation procedure and issues the expropriation decision. Once the expropriation decision becomes final, “Roads of Serbia” is required to submit a written offer specifying the form and amount of compensation for the expropriated property.

The amount of compensation for land is determined by the Tax Administration, while compensation for crops and structures is determined by court-appointed experts of the relevant profession. The compensation agreement is concluded before the competent municipal authority.
